West Virginia's 1880 constitutional amendment splits county government into seven separately elected offices: County Commissioner (three per county, staggered 6-year terms), County Clerk (the Clerk of the County Commission), Circuit Clerk, Sheriff, Assessor, Prosecuting Attorney, and Surveyor. Circuit Clerk, Sheriff, Assessor, Prosecuting Attorney, County Clerk and Surveyor run on 4-year terms and were last elected together in 2026, so they are not up again until 2030. County Commission is different: each of the three seats runs on its own staggered 6-year clock, so whether your county has a Commission race in 2028 or later depends on when that specific seat was last filled. The County Clerk, listed for every county below, is the office that actually runs the election, accepts filings, and is the right first call for anything county-specific this page does not answer.

These dates are set statewide by statute, not by each county individually -- but confirm the current-year date with your County Clerk before relying on it, and check whether your specific seat is even on the ballot in a given year; County Commission seats stagger and not every office is up every cycle.

West Virginia's 1872 Constitution, as amended in 1880, names seven county offices that voters elect directly: County Commissioner, County Clerk (Clerk of the County Commission), Circuit Clerk (Clerk of the Circuit Court), Sheriff, Assessor, Prosecuting Attorney, and Surveyor. The county's Board of Education is elected separately on a nonpartisan ballot. The order these appear on the ballot -- Circuit Clerk, County Commissioner, County Clerk, Prosecuting Attorney, Sheriff, Assessor, Surveyor -- is fixed by statute (W. Va. Code Sec. 3-5-13a).

• County Commissioner -- three per county, staggered 6-year terms, one seat up roughly every two years; which of your county's seats is up in a given year depends on when that seat was last filled.
• County Clerk (Clerk of the County Commission) -- elected countywide, 4-year term, last up 2026, next up 2030. Accepts candidate filings for every county-only office and administers elections alongside the county's ballot commissioners.
• Circuit Clerk (Clerk of the Circuit Court) -- elected countywide, 4-year term, last up 2026, next up 2030.
• Sheriff -- elected countywide, 4-year term, last up 2026, next up 2030.
• Assessor -- elected countywide, 4-year term, last up 2026, next up 2030.
• Prosecuting Attorney -- elected countywide, 4-year term, last up 2026, next up 2030.
• Surveyor -- elected countywide, 4-year term, last up 2026, next up 2030; several counties do not staff this office in every cycle.
• County Board of Education -- elected on a separate nonpartisan ballot, not the partisan county ticket; filed with the County Clerk like every other county office.

Jefferson County is the one exception to West Virginia's usual three-member commission: it elects a five-member County Commission rather than three. Every other county elects three commissioners. Confirm which offices your county fills separately, and which Commission seat (if any) is up in a given year, with the County Clerk.

How to get on the ballot.

West Virginia offers three routes onto the county ballot: file with a party ahead of the primary, petition on as an independent or minor-party candidate ahead of the general, or file as a write-in. The 2026 party-primary and independent-petition routes have both closed, but the write-in route for the November 3, 2026 general election is still open through September 15, 2026.

Party primary filing -- 1% of salary for most county offices, already closed for 2026.

A candidate for Sheriff, Prosecuting Attorney, Circuit Clerk, County Clerk, Assessor, County Commission or Magistrate pays a filing fee equal to 1% of the office's annual salary, excluding any additional compensation (W. Va. Code Sec. 3-5-8(a)(4)). A candidate for County Board of Education pays a flat $25; a candidate for any other county office (including Surveyor) pays a flat $10. Filing goes to the Clerk of the County Commission, not the Secretary of State.

Independent or minor-party nomination -- signatures instead of a fee, already closed for 2026.

An independent or minor-party candidate who did not run in the primary petitions onto the general-election ballot instead of paying a filing fee (W. Va. Code Sec. 3-5-23). The nomination certificate needs signatures equal to at least 1% of the total votes cast for that office at the last preceding general election, and is filed with the Clerk of the County Commission for a county office.

Write-in candidates -- the door still open for November 3, 2026.

A write-in candidate files a sworn certificate of announcement with the Clerk of the County Commission no later than the close of business on the 49th day before the election (W. Va. Code Sec. 3-6-4a). For the Nov 3, 2026 general election, that deadline is Tuesday, September 15, 2026. The certificate must be notarized and states the office sought, the candidate's legal name and the name to appear on any write-in tally, and a sworn statement that the candidacy is made in good faith.
