Terms of Service

These terms are the agreement between you and Motion51 when you create an account, sign in, or use the Motion51 canvassing application. We've written them in plain English on purpose. If you have questions, email jason@motion51.com.

1. Who we are and what you're agreeing to

Motion51 is operated by Jason Becher in Florida (“Motion51,” “we,” “us”). By creating an account or using the service, you (and the campaign or organization you act for) agree to these terms. If you are accepting on behalf of a campaign, you confirm you have authority to do so.

2. What your subscription buys

Your subscription fee pays for access to the Motion51 software: turf mapping, the mobile canvassing app, reporting, and related tools. Where Motion51 provides voter registration data, that data is furnished at no separate charge, solely for the permitted political uses described in section 4. Motion51 does not sell voter data.

4. Voter data: permitted use only

Voter registration data in Motion51 comes from state and county election officials (or from files you lawfully provide). State law restricts how this data may be used, and those restrictions flow through to you. You agree to use voter data available through Motion51 only for political and election-related purposes — canvassing, voter outreach, get-out-the-vote activity, petition efforts, and campaign planning.

You agree that you will not:

We filter records that states flag as confidential or address-protected, and you agree not to attempt to identify or locate such voters. We may suspend or terminate any account that misuses voter data, without refund, and this section survives termination of your account.

Don't use Motion51 to break the law. Don't scrape, bulk-extract, or programmatically harvest data outside the features we provide. Don't probe, overload, or interfere with the service, attempt to access other campaigns' data, or reverse-engineer the software.

8. Availability

We work hard to keep Motion51 up, especially around election days, but we can't guarantee uninterrupted availability. The mobile canvassing app is built to keep working offline once a volunteer's turf is loaded — we recommend volunteers open their turf while online before heading out. We may perform maintenance, and we'll try to schedule it away from peak canvassing times.

9. Disclaimers

Motion51 is provided “as is.” Voter data originates with government offices and third parties; it contains errors, and people move, re-register, and pass away. We make no warranty about the accuracy or completeness of voter data or about the service being error-free. Nothing in Motion51 is legal advice: your campaign is responsible for complying with the election, canvassing, and campaign-finance laws that apply to it.

10. Limitation of liability

To the fullest extent permitted by law: Motion51 will not be liable for indirect, incidental, special, or consequential damages (including lost votes, lost elections, or lost data), and our total liability for any claim arising from the service is limited to the amount your campaign paid Motion51 in the twelve months before the claim arose. Some states limit these disclaimers, in which case they apply to the maximum extent allowed.

11. Your responsibility for misuse

If your campaign's (or your volunteers') use of voter data in violation of section 4, or content you upload, results in a claim against Motion51, you agree to indemnify us — that is, to cover the losses and reasonable costs that claim causes us.

13. Changes to these terms

If we change these terms materially, we'll post the new version here, update the date at the top, and take reasonable steps to notify active accounts (such as an email or an in-app notice). Continuing to use Motion51 after changes take effect means you accept them.

14. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Florida, and both sides consent to that venue.
